(1) both parties are at least 18 years old;
(2) neither party is legally mentally incapacitated or declared incompetent by the court;
(3) neither party is a bloodline-related, sibling, or adoptive-related individual;
(4) Neither party is already married.

For a divorced woman, the re-marry is possible 310 days after the divorce unless she has given birth during the period, has a medical certification that not pregnant, re-marriage, or permits by court order.

The registration process requires an ID card or an equivalent document, such as a passport; foreigners also require a status certificate which proves that they are single from their home country or the embassy in Thailand; and all documents in foreign languages must be translated into Thai. Two witnesses of legal age are also required during the process. The process takes no more than 30 minutes and can be done at district registration offices, municipal offices, and Thai embassies/consulates for free of charge.
